LIMITED WARRANTY

PERIODS AND PRODUCTS UNDER WARRANTY
The PS limited warranty covers the following time periods and the following products of:
 
• “For life” means for the entire time that the original minor buyer is the    owner of the vehicle in which the PS products were originally installed.
• Branded” means that the PS logo is visible and physically marked on the   outside of the covered product.
 
WHAT DOES THIS WARRANTY COVER?
This warranty covers defects in materials and workmanship of the covered PS products listed above. The sole and exclusive obligation of PS and the sole and exclusive remedy for the original retail purchaser under this warranty is limited to the exchange or replacement of a defective covered PS product in accordance with this limited warranty.
 
IS THIS WARRANTY TRANSFERABLE?
NO. This warranty cannot be assigned or otherwise transferred to a subsequent buyer or user of the product and the sale or other transfer of the product will invalidate this warranty and from now on PS will have no obligation or liability related to it.
 
HOW TO FILE A WARRANTY CLAIM?
To file a warranty claim for an allegedly defective PS product, the original retail purchaser must do the following:
1. Bring the original retail purchase receipt (i.e. the original receipt) in which the valid PS part number of the covered product is indicated to the original place or point of purchase.
2. The product must be inspected to verify that it qualifies for a replacement or Exchange in accordance with the terms of the warranty. Inspection and verification are provided free of charge to the original retail purchaser.
3. In order for the product to be inspected and verified, the original purchaser must (a) return the allegedly defective PS product to the original place or point of purchase and (b) deliver a valid copy of the original proof of purchase with date that includes a valid PS part number for inspection and verification. If the original place or point of purchase no longer exists or if for some other reason the original retail buyer cannot, despite having done its best, return the product to the original place or point of purchase, the original buyer must then return the allegedly defective PS product and proof of purchase to an authorized seller of PS products. At www.proshocksuspension.com there is a list of authorized sellers of PS products.
4. Only warranty claims will be accepted for the PS products listed above and that are not otherwise excluded from this Limited Warranty.
5. If the provisions of this warranty are met and it is determined that the product is defective and qualifies for replacement / exchange, the product will be replaced / exchanged for a new unit of the same part number, or PS replacement part number. If a PS product has been replaced by another, the replacement part number must be indicated in the applications section of the current PS catalog.

6. This warranty does not include installation, disassembly and diagnosis.

WHAT IS WHAT THE WARRANTY DOES NOT COVER?
The PS Limited Warranty does not apply to PS products that (a) are worn, but not defective; (b) do not qualify due to the expiration of the warranty period specified above for each product; (c) they were installed in applications not included in the catalog; (d) they were purchased from an unauthorized reseller of PS parts; (e) they were altered modified, adapted, applied or installed incorrectly or misused; (f) they were installed in vehicles for commercial or racing use and / or (g) they are damaged due to modifications or accidents of the vehicle (an example is when a single unit is defective and the consumer wants the pair replaced. The PS warranty only covers the defective unit, the claim for the worn-out but not defective unit will not be accepted.) It does not include the cost of diagnosis and disassembly of a defective PS product and the installation of the replacement PS product. This warranty does not cover the cost of transportation for the shipment of an allegedly defective or replacement PS product.

THE LIMITED WARRANTY OF PS IS INSTEAD OF, AND EXCLUDES, ALL OTHER WARRANTIES EXPRESSED, IMPLIED, ESTABLISHED BY LAW OR CREATED IN ANOTHER WAY UNDER THE CORRESPONDING LAWS; IN THE UNDERSTANDING, HOWEVER, THAT ALL IMPLIED WARRANTIES, WARRANTIES OF MERCHANTABILITY, AND ALL WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED TO THE PERIODS OF THE LIMITED WARRANTY HEREBY STAMPED FOR PS COVERED PRODUCTS, PS WILL NOT BE RESPONSIBLE FOR, INDIRECT, SPECIAL, UNEXPECTED OR RESULTING OF ANY NATURE.


THE LIMITED WARRANTY OF PS GRANTS YOU CERTAIN LEGAL RIGHTS AND YOU MAY HAVE OTHER RIGHTS THAT MAY VARY FROM ONE STATE TO ANOTHER. SOME STATES DO NOT ALLOW THE LIMITATIONS OF LIMITED WARRANTIES OR THE EXCLUSION OF LIMITATION OF IMPROVED OR RESULTING DAMAGES, THEREFORE, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOUR CASE. SOME STATES DO NOT ALLOW LIMITATIONS IN THE DURATION OF AN IMPLIED WARRANTY, SO IT IS POSSIBLE THAT THE ABOVE LIMITATION DOES NOT APPLY TO THIS CASE.

RESOLUTION PROCESS – BINDING ARBITRATION
Any disagreement, dispute, controversy or claim arising out of or related to this Limited Warranty or PS products must be presented as the original retail individual purchase and will be resolved through binding bilateral arbitration located in Indiana, before a single arbitrator in accordance with the rules of the American Arbitration Association (AAA) and the Federal Arbitration Act Act, (FAA). The original retail purchaser cannot file a claim for disputes related to the covered products. Instead, the original retail buyer must file any dispute through the AAA, which includes mandatory bilateral arbitration that is binding on both PS and the buyer.

The arbitrator’s decision may be recorded in any court with jurisdiction over the matter. If there is no separate written agreement signed between PS and the original retail one, no group arbitration will be allowed and the original retail purchaser is allowed to act as a representative of a group or as a member of a group of claimants related to a claim subject to arbitration. Nor can another person’s claim be attached to the original retail buyer’s claim, nor may the original retail buyer act directly or indirectly as a representative on behalf of another person’s claim.
